The Land & Environment Court granted the developer’s appeal; however the developer has now submitted a modification to the original DA.
APA continues to oppose this inappropriate development in Palm Beach.
Background
This proposed shop top and apartment development would be completely incompatible with the required “seaside character” and would grossly breach the permitted height limit; it would completely overwhelm the adjoining heritage-listed Barrenjoey House; and the proposed on-site parking is below the required minimum.
NBC required the applicant to submit a new DA rather than relying on the original 2014 DA and the subsequent Modification (Mod2021/0203). This was also the recommendation of Council’s Design + Sustainability Advisory Panel in its report.
APA opposed this new DA2022/0469 and made a submission to Council. The DA was referred to Northern Beaches Local Planning Panel (NBLPP) and the Panel recommended the DA be refused. On 20 April 2023 NBC formally refused the DA – see the Determination here. An appeal was lodged
The developer, Asia Digital Investments Pty Ltd, appealed the Northern Beaches Local Planning Panel decision to the Land & Environment Court which, consistent with its customary practice, granted the appeal, even though its own judgement conceded the objections by Council regarding bulk, setback, non-compliance etc.
